I am currently in chapter 13 bankruptcy and would like to know if there is anything legally I can do about refianancing my ARM mortgage. I do have a lawyer but when asked I did not get a clear answer. My ARM is about to go up again in January and I am afraid I will be forced to leave my house because I wont be able to afford it.

Is your mortgage being paid through your chapter 13 plan (do you pay it directly to the trustee) or is it outside your Chapter 13 plan payments?
